Expert in American water law to study Alberta’s water rules as Fulbright Visiting Research Chair at the U of L

The hot, dry summer across western North America was a reminder of the importance of carefully managing the water supply but it’s something Reed Benson, a faculty member in the ��Ѹ��Դ��߿�Ƭ of New Mexico School of Law, has been aware of since his earliest days growing up on the American plains.

“I have always felt that water was important not just to societies and communities and ecosystems, it was also important to me. I went to law school thinking I could learn something to help me play a role in how water was managed. That’s always felt like the best use of my time,” he says. “I’ve spent my career working on issues of water and the environment.”

Benson will be spending the fall semester in southern Alberta as he conducts research into water law as the Fulbright Visiting Research Chair in Water and the Environment. He was drawn to the U of L because of its focus on water research and the expertise available here.

“I have always focused on the water challenges of the western United States and there are enough similarities in southern Alberta, both on the water supply and demand side and the legal aspects, that I thought I could learn some relevant lessons here,” says Benson.

In the western United States, as in southern Alberta, water was historically allocated without much thought about environmental impacts. Most of the widely available water has already been allocated, largely for irrigation purposes, says Benson. Now, it’s better understood that taking too much water out of a river damages aquatic and riparian ecosystems and the challenge is to develop water management practices that take the health of the river into account, along with the needs of society and the economy.

While some similarities exist between water laws in the United States and those in Canada, Benson is particularly interested in how Alberta changes operating plans for water projects like dams and reservoirs in light of changing needs for water, increasing scientific knowledge, and the expected effects of climate change. In the western U.S., the federal government operates many of the major dams.

“The practice has really been not to revise the operating plans for these reservoirs even though all of those things are changing and they’re not required to revise them,” he says. “It makes a lot of sense to engage the public and stakeholders to talk about how a dam should be operated in the future. In Alberta, there seems to be more willingness to be flexible in looking at some of these same issues.”

Benson will be studying developments in the Oldman and Bow river basins. In addition to collaborating with researchers at the U of L, Benson will also connect with law professors at the ��Ѹ��Դ��߿�Ƭ of Calgary and the ��Ѹ��Դ��߿�Ƭ of Alberta.

“With the Rockies and the plains, this is a beautiful, interesting part of North America and I am excited to have the chance to spend a few months here,” he says.

Fulbright Canada is a not-for-profit organization with a mandate to identify the best and brightest minds in both the United States and Canada and engage them in academic exchange. Fulbright Canada provides support to students, teachers and independent researchers through a variety of programs, including the Fulbright Visiting Research Chairs Program.

5 Questions With Dr. Henning Bjornlund

Dr. Henning Bjornlund is a Canada Research Chair in Water Policy and Management at the ��Ѹ��Դ��߿�Ƭ of Lethbridge and a professor at the ��Ѹ��Դ��߿�Ƭ of South Australia. He has researched water policy and management issues in Australia since 1993 and in Canada since 2005. He recently served on the Ministers Advisory Group on Water Allocation and Management in Alberta, and has written widely about water policy and management issues with more than 275 publications and presentations.

What first piqued your interest in your research discipline?

Prior to starting my first academic degree in 1990, I was the managing director for a company operating tropical plantations in South and Central America, the Caribbean and the South Pacific. As part of this work, I bought properties and negotiated access rights to water to grow bananas, citrus, rice and other tropical crops highly dependent on water.

While studying for my bachelor's degree I had to do a third-year research project and chose to concentrate on the impact of water policy on rural land values. This required a careful study of the literature on water markets and water rights. I continued this theme through both my master's and PhD studies.

Dr. Henning Bjornlund is one of the foremost experts in water policy and management issues.

How is your research applicable in "the real world"?

Water is probably the most important and valuable resource in the world. All human activity depends on it in one form or another. It is available in a finite quantity and has a finite ability to assimilate waste. Most human and economic activity in some way impacts on water quality and the availability of water. Human activities have had a serious impact on water bodies and the ecosystems dependent on them. Policy makers around the world are trying to come to terms with how to reverse this trend of environmental degradation, how to continue our human activities while minimizing our impact on the environment, how to use less water and be more efficient, how to produce more from less and how to share our limited resources. All of these issues are central to my research.

What is the greatest honour you have received in your career?

The greatest honour and privilege that I can receive as an academic is an invitation to contribute to policy making, the development of professional standards or to public debate and awareness. Hence, invitations to serve on entities such as the Ministers Advisory Group on a new Water Management and Allocation framework for Alberta, to produce a policy commentary to contribute to the debate on water management and policy in Alberta, or help write a policy document for the Royal Institute of Chartered Surveyors (RICS) in London on the implications of changing water policies for property professionals are among the greatest honours I have received.

How important are students to your research endeavours?

Student participation is an integral part of my research program. I currently have seven PhD students and five master's students in Canada and Australia working on various issues related to water policy and management. Apart from answering pressing questions about how to resolve the world's growing water problems, a very important task is the building of human capacity to deal with these issues. Student training in this area is very important.

If you had unlimited funds, which areas of research would you invest?

How to share limited resources is one of the most challenging issues facing policy makers and water managers. This is a very complicated issue in that those who currently have the right to use water have invested a lot of time and money to be able to do so. Hence, any change in the way water is allocated can potentially have significant socio-economic impact on the current generation of water users, not the least of which are irrigators and the communities that currently depend on water use as the economic engine of their community. If I had unlimited funds I would like to conduct a Canada wide investigation of how people perceive a reallocation should take place, how such perception varies across Canada and what causes the variation. Such insight would assist the development of a national water plan or policy, as well as the development of provincial water policy plans.

Improving the management of natural resources in Alberta, Canada and around the world is the goal of a new research centre announced recently by federal Minister of State (Science and Technology) Gary Goodyear.

Funded under the federal Centres of Excellence for Commercialization and Research (CECR) program and industry/government partners, the new Centre of Excellence for Integrated Resource Management will be the first of its kind in the world to focus geomatics science and engineering expertise towards the complex problems of large-scale resource and environmental management.

The centre will be led by Dr. Naser El-Sheimy, holder of a Canada Research Chair and the head of the Department of Geomatics Engineering in the Schulich School of Engineering at the ��Ѹ��Դ��߿�Ƭ of Calgary and involves partners at the ��Ѹ��Դ��߿�Ƭ of Alberta, the ��Ѹ��Դ��߿�Ƭ of Lethbridge and other Canadian universities, the Province of Alberta and industry partners.

"This is a research and development centre that will lead to the commercialization of geomatics tools that will help ensure the responsible maintenance and management of resources in Canada and in countries across the globe," U of C Vice-President (Research) Rose Goldstein says. "A centre of this calibre will undoubtedly attract some of the leading researchers in the field to our province."
"At the ��Ѹ��Դ��߿�Ƭ of Lethbridge, we have been working on – and investing in – this program for the past six years," says Dr. Dennis Fitzpatrick, Vice-President,
Research. "We brought to Lethbridge senior remote sensing scientists like Dr. Philippe Teillet and Dr. Karl Staenz to join Dr. Craig Coburn and Dr. Derek Peddle, and this group of experts is housed in our new Alberta Water and
Environmental Science Building. The optical imaging of the earth is important to Alberta – for land and water management, as well as other natural resources and urban issues."

Fitzpatrick adds that the new centre at the ��Ѹ��Դ��߿�Ƭ of Calgary and the collaborative focus between researchers and institutions represents a natural partnership where researchers can combine efforts to create a stronger program than they ever could individually.

"We expect the impact of this announcement, and the research generated from it, to have far-reaching implications," Fitzpatrick says.
"At the U of L, we are already at work on commercial applications for remote sensing through our partnership in the Alberta Terrestrial Imaging Centre, which we operate with pioneering local business Iunctus Geomatics. As well, we have numerous undergraduate and graduate students currently studying this technology. They will take advantage of the educational and research opportunities generated by our people and others involved in this high-tech activity."

The extended time frame for funding – up to five years initially – allows for the significant development of new research and researchers, according to Dr. Philippe Teillet, who joined the U of L faculty in 2006 (Department of Physics and Astronomy). Teillet is a remote sensing researcher working with colleagues in the Alberta Water and Environmental Science Building.

"I came to the ��Ѹ��Դ��߿�Ƭ of Lethbridge with my colleague Karl Staenz, and our goal was to help build research capacity and add to the projects that are already putting the U of L on the remote sensing map. This announcement is a validation of our approach, which was to be collaborative and flexible. Once programs are up and running, we will be working not individually, but in multiple teams. Together we can be even more productive."
